- The 3AP Material is the property of 3AP and its suppliers;
- You will not use the 3AP Material for any purpose other than is expressly permitted by these Terms;
- You will not distribute in any medium any 3AP Material without 3AP prior written authorization or as expressly provided in these Terms.
- Any distribution or past distribution of any 3AP Material that violates these Terms is subject to liquidated damages in an amount equal to that which would be payable by a copyright infringer for knowingly copying a work, and based on each page of any website which uses 3AP Material being a separate work under the Copyright Act and each access of a page of a website by a customer being a separate publication of a work.
- 3AP shall have the right to represent its suppliers in any dispute.

- When you purchase products or services (Account) on our Site, you agree to the following:
- You are solely responsible for your account and the security and privacy of your account, including passwords or sensitive information attached to that account; and

To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose.

- 3AP does not authenticate users’ signatures or identities. 3AP electronic signature functionality does not track IP addresses, including digital certificates, use a certification authority nor any other third-party verification. You accept full responsibility for determining whether an electronic signature is suitable for any particular purpose.
- Except as expressly provided in these Terms or where prohibited by law, we are not responsible for any loss, injury, claim, liability, damage or consequential damage related to your use of 3AP Material and 3AP Services, or for inaccessibility of 3AP Material and 3AP Services whether from errors or omission in the content of 3AP Material and 3AP Services or any other linked sites or for any other reason. Use of 3AP Material and 3AP Services is at your own risk.
- 3AP does not represent or warrant that 3AP Material, the Site or any linked sites are free of any harmful materials.
Limitation of Liability
- To the fullest extent permitted by applicable law, we will not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of or in connection with your use of our Site, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, even if we have been advised of the possibility of such damages.
- Except as expressly provided in these Terms or where prohibited by law, the maximum liability of 3AP is the amount paid to 3AP by the customer, however, where 3AP has provided a service, the maximum liability of 3AP for any 3AP Services is the portion of the amount paid to 3AP by the customer specifically for the 3AP Services as calculated by 3AP.
Indemnification
You agree to indemnify and hold 3AP, its directors, officers and employees, harmless from any actions, claims, damages, loss, liabilities, costs, and expenses (including reasonable legal fees) asserted by any third party due to or arising out of or in connection with your use of our Site or any breach of these Terms.
Restrictions
- To the maximum extent allowable under applicable law, except as explicitly identified in these Terms, you agree not to publish, re-publish, lend, license, give away, look at the software source code, modify the software source code, post to an internet web site, or use in an automated system any 3AP Material nor will you utilise 3AP Material in any way for the creation of an automated system or Site, nor will you allow or assist a third party to do so.
- You agree to only use 3AP Material and the Site as a customer.
- Licences granted are subject to these Terms, and are non-exclusive, non-transferable and revocable.
- The rights granted under these Terms are granted to you only.
- 3AP retains the right to prohibit organisations, groups, or individuals, or yourself from using its Site or 3AP Material or 3AP Services at its discretion.
Guarantees and Refunds
- The Australian Consumer Law (ACL) provides certain guarantees to consumers when they purchase goods and these guarantees cannot be excluded, restricted or modified.
- The following additional restrictions apply to the guaranteed payments for mistakes:
- The customer was the first person to mention a mistake for the Guarantee category.
- Guarantees only apply to 3AP mistakes, not to customer mistakes.
- 3AP are only required to pay a customer once for a mistake no matter how many mistakes they may bring to our attention.
- Our maximum liability for any guarantee or refund commitments specified in 3AP Material, or by law, are subject to a maximum of the amount paid by the customer and are subject to a claim being submitted within 30 days of purchase.
Client Privacy
You consent to 3AP using your personal information according to its Privacy Policy – See below.
Changes to Terms and Conditions
- Unless expressed by law that you must be informed in a reasonable manner regarding any pricing increase, 3AP may at its sole discretion change these Terms at any time.
- We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of our Site after any such changes constitutes your acceptance of the updated Terms.
Terms & Headings
All of the Terms are valid regardless of the heading. To the maximum extent possible under law, the Terms take precedence over any conflicting 3AP Material should it be judicially found that the conflicting 3AP Material is legally relevant to this Agreement under law.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of New South Wales, Australia, without giving effect to any principles of conflicts of law. Any disputes arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts of New South Wales, Australia.
Waivers
No failure or delay on the part of 3AP in exercising any right or power under these Terms will operate as a waiver of such right or power.
Whole Agreement
Except as explicitly set forth in this agreement, these Terms, the pricing displayed on the Site, and the Site’s Disclaimer/s, constitute the whole agreement between you and 3 Axes Print Pty Ltd (3AP) not withstanding any:
- 3AP Material other than this Agreement
- Communication between you and 3AP including telephone and email
- Announcements, newsletters or promotional material from 3AP
Severability
If any part of this Agreement is found to be void, unlawful or unenforceable then that part will be deemed to be severable from the balance of this Agreement and the severed part will not affect the validity and enforceability of any remaining provisions.

Our company, 3 Axes Print Pty Ltd (3AP) is committed to protecting the privacy of our customers and visitors to our website (Site). This Privacy Policy applies in addition to the Terms and Conditions of Use of our Site.

- Third parties will not be able to access user data beyond what is reasonable to achieve the given purpose.

How Long We Store Personal Data
As governed by Australian Regulations, user data will be stored for 2 years.

Do Not Track Notice
Do Not Track (“DNT”) is a privacy preference that you can set in certain web browsers. We do not track the users of our Site over time and across third party websites and therefore do not respond to browser initiated DNT signals. Shipping Policy
- We strive to process and ship all orders within 3 business days of receipt of cleared payment, unless otherwise stated. Please note that this period may be longer for customized or made-to-order items.
- You are responsible for all shipping, export and/or import costs associated with your purchase or, if applicable, return shipping expenses to 3AP if making a warranty or refund claim.
- 3AP currently offer domestic shipping within Australia as well as international shipping to select countries. Please note that international orders may be subject to additional fees and delays due to customs regulations.
- We offer shipping options with Australia Post and Aramex, and you will have the option to select the carrier that you believe can provide the best service for your order.
- We will provide you with a tracking number once your order has shipped so you can track your package.
- Where goods are damaged or defective upon delivery, you must first contact your courier service.
- 3AP accepts no liability for damage occurred during transit by any courier or delivery service.

Returns Policy
The Australian Consumer Law (ACL) provides certain guarantees to consumers when they purchase goods and these guarantees cannot be excluded, restricted or modified.
- If you are not satisfied with your purchase, you may return it to us within 30 days of receipt for a full refund or exchange, subject to the following conditions:
- The item must be in its original condition and packaging.
- You must contact us to obtain a return authorization before shipping the item back to us.
- You are responsible for all shipping costs associated with returning the item unless the return is due to our error or a defective product.
- All refund claims must firstly be directed by email to solutions@3ap.com.au. In order to make a claim you must include:
- Details of the defect or damage in relation to which you are making a claim;
- Photographic evidence of the defect or damage where applicable;
- Your invoice and any other proof of purchase &
- Any other details we may need to process your claim.
- When making a claim you must comply with all return instructions provided to you via your email address used at time of purchase.
- Except as required by law, refunds or store credit shall not apply in respect of goods:
- Where the goods have not been installed, maintained, operated or used in accordance with the instructions or any other specifications provided with the goods;
- Where damage or defects are caused by deliberate or negligent misuse or abuse, physical alteration, fire, liquid spillage, use of incorrect voltage, power surges or dips, thunderstorm activity, force majeure, voltage supply problems and interruptions, tampering or unauthorised repairs by any persons, use of defective or incompatible accessories, corrosive conditions, computer viruses or introduction by an insect, pest or other foreign body;
- Where damage results from any third-party goods not provided by us;
- Where items are lost or stolen
- Once we receive your returned item, in the case of refund claim, we will inspect it to ensure that it is in its original condition and packaging. In the case of a warranty claim, we will commence an investigation of failure.
- If applicable, or directed by Australian Consumer Law (ACL), we will then process your refund or exchange within 30 business days.
- Please note that customized or made-to-order items are not eligible for return unless by law and they are defective or there was a proven error on our part.
- Where goods are damaged or defective upon delivery, you must first contact your courier service. 3AP accepts no liability for damage occurred during transit by any courier or delivery service.
- If any returned goods are found to be in good working order, we may seek reimbursement, at our discretion, for any costs incurred by us in relation to such goods. In such cases, you agree that we may hold your goods until such payment is received.
